Terms of Use

These Terms of Use (“Terms”) govern your use of snipe.cardcapsule.com (the “Service”), operated by Card Capsule (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service does

The Service allows you to schedule bids on eBay auction listings. When you schedule a “snipe,” you set the maximum amount you are willing to pay, and the Service submits a bid on your eBay account shortly before the auction ends, using authorization you grant through eBay’s official sign-in system. Bidding is then handled by eBay’s own proxy bidding system, exactly as if you had placed the bid yourself on eBay.

2. Eligibility and accounts

You must be at least 18 years old, have a valid eBay account in good standing, and comply with eBay’s User Agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it current.

3. eBay authorization

To use the Service you must link your eBay account through eBay’s authorization process. You may revoke this authorization at any time through your eBay account settings or by unlinking your account in the Service. Revoking authorization will cause scheduled snipes to fail. We never receive or store your eBay password.

4. Bids are real and binding

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. Bids placed by the Service on your behalf are real bids on your eBay account. If you win an auction, you enter a binding agreement with the seller under eBay’s rules, and you are obligated to complete the purchase and pay for the item. Scheduling a snipe means you intend to buy the item at up to your stated maximum bid. You are solely responsible for the bids you schedule, for reviewing item listings before scheduling, and for all consequences of winning an auction, including payment, and for any consequences on your eBay account. Cancel any snipe you no longer want before it is scheduled to fire.

5. No guarantee of bid placement or outcome

The Service places bids on a best-effort basis. We do not guarantee that any bid will be placed, placed on time, or succeed. Bids may fail or be missed due to circumstances including, without limitation: internet or server outages, eBay system downtime or changes, listings ending early or being modified by the seller, revoked or expired eBay authorizations, bid amounts below the required minimum, or seller restrictions. We are not responsible for auctions lost, bids not placed, or opportunities missed for any reason. We are also not responsible for auctions won: winning at your maximum bid (or below it) is the intended function of the Service.

6. Acceptable use

You agree not to: use the Service to violate eBay’s User Agreement or any applicable law; use the Service to manipulate prices, engage in shill bidding, or bid on your own listings; attempt to interfere with, disrupt, or reverse engineer the Service; access the Service through automated means other than the interfaces we provide; or create accounts through fraudulent means. We may impose reasonable limits on usage (such as the number of active snipes) and may modify such limits at any time.

7. Fees

The Service is currently provided free of charge. We reserve the right to introduce fees or paid tiers in the future, with notice posted on the Service before any charges apply to you.

8. Relationship to eBay

Card Capsule is not affiliated with, endorsed by, or sponsored by eBay Inc. “eBay” is a trademark of eBay Inc. The Service interacts with eBay through eBay’s official developer APIs under eBay’s applicable agreements. Your use of eBay remains governed by eBay’s own User Agreement and policies.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by eBay or by law, or if we discontinue the Service. Sections 4, 5, 10, 11, and 12 survive termination.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARD CAPSULE AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, SAVINGS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BIDS PLACED, NOT PLACED, OR PLACED INCORRECTLY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR FIFTY U.S. DOLLARS ($50).

12. Indemnification

You agree to indemnify and hold harmless Card Capsule from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of any law or of eBay’s policies, or your transactions with sellers on eBay.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
